Looking at the recent approvals looks like USCIS does the following:
1. Pick up x number of files using a random algorithm.
2. Arrange these files in a random order using the same random algorithm
followed in step 1.
3. Randomly pick any file arranged in step 2.
4. Toss a coin.
5. On odd dates if it is heads,approve the file. On even dates if it is tails
approve it.
6. If file is not approved in step 5 put it on the shelf to be picked up
in step 1 in next cycle.
I can only hope you are wrong :). I hope they sort first by PD and then by RP.

Guys good news from my side. Just got most awaited Card production Ordered emails for my wife and my son. I have not received the email for myself though. When I checked the status on Case Status Online site, I found that 485 for all three of us have been approved.
My priority date was Oct 2004 at NSC. Came to US in Feb 2000, so almost 8.5 years of waiting is finally finally over. I hope that NSC picks up the pace and approve all the people who are current.
Trust me!! I am not going anywhere. I will enjoy my green but at the same time will always work relentlessly to get the immigration reforms. I also prey from God almighty that all my friends/family members stuck in EB2/EB3 will also get their GC ASAP.
Wish you all the best, even though I have crossed the fence towards the greener pasture, I am always there to lend you a hand and help you climb up and jump across the fence.

If implemented, would this cause audits/additional reviews of already approved I-140s? My 140 was approved in January 2007 in EB2 - Exceptional Ability/Advanced Degree. Hope this does not cause any issues for people like me....

What spillover for EB3 you are talking about? Based on how they interpreted the spillover law last year, EB3-I can't get any spillover until EB2-I and EB3-ROW is current and thats decade away.
I am just trying to get the facts. I am not against EB3-I as I myself is EB3-I and waiting for my turn since last 7 years.

I Agree with you, EB3 I will never ever be current unless there is a resolution or releaf passed by Mr Change (Obama) or his lobby, there is no light beyond this tunnel until we see some releaf which does not look getting this year atleast and may be another couple of years.
Predictions are good to just hear and watch and here predictions are like lovely dreams which will never come true unless untill any big chnage is taken place, and the only person who i have hope with to do something for EB3 I is President Obama.
But he is kind of busy with other important issues and our issue is not that important for him reason may be we are not his vote bank and will get to the curve of getting the GC when we are very close to our graves.
This is really furstating and freinds sorry to express my frustration here on this forum but i am done and just look at my PD Dec 2001 for the past 1 year i hear from my lawyer you are just the next badge and should be current in the next bulletin.
I think we should live everything aside and just do our best at work thats what i am doing and thank god for getting our bread and butter in this economy.

We are one of those unluckiest ones; I changed my company 2 months before July fiasco and (EB2 PD Aug 23, '06) and never got a chance again to file I-485.
It is very frustrating (to say the least) to wait and it seems it may take another ~2 years to file I-485. It is hard on my wife in particular as she completed her masters in 2008 and narrowly lost jobs offers because companies do not wanted to H1b transfer these days.
I do not see any hope of this agony end anytime soon :(

Some one get list from Walk In Medical Care who all went to medicals for 485 in June :D :D .
When I went for submitting and collecting medicals there were around 15 + each time last month.

Receipt date is not the date when the application reaches the service center. It is infact the date when your application is entered into their internal system which could be several days after the application has reached the service center.
And all application they enter into the system.. then give us a Receipt Date Right ... from that time we can apply for EAD / AP (will take time again)

In order to avoid visa wastage, there is no �per country limit� during the last quarter, that could be the main reason for this quantum leap in EB2-I PD movement.
The per country limit was not adhered to even in the 3rd quarter. Remember how EB2 India rose like a phoenix from Unavailable to April 2004? Once they determine that there are enough visas for spillover, the per country limits don't exist. The question is how they decide to distribute it among the retrogressed countries.

You should be happy as you have a very old PD.
As u mentioned that you applied in mid june but the receipt date is mid july. What is your notice date? I thought that receipt date is the date when uscis receives your application. I may be wrong.
RECIPT DATE is the date when they input your info in the system. Before inputting in the system they check I140,medicals,etc. Notice date has no bearing. If your packet looks fine you get your receipt number and then you will be able to view the status on uscis.gov. The status will be something like "On july 9th 2007 we received your applivction ..............etc"

In my opinion, the most likely reason why EB2 India dates have been advanced to June 2006 is to help consular posts. CP filers can get their interviews now.
IMO, This along with the max utilization of ideal 100% is what DOS got at by moving EB2 to 06/01/2006.
It appears like DOS wants to get each and every visa number allocated and given how USCIS have their files across the country, moving it well beyond gives USCIS a chance to pick the files that are handy.
In other words, Some on with Jan 06 PD can get out if their file is handy. Some one with Jan 04 (there are still who dont have a GC with 03 and 034 PD's) might still be waiting come dec 08., if their file is rotting some where.
IMO, OCT bulletin will start EB-2 India some where around APR 04.

Do not think about inabilities of USCIS or it's management. I strongly believe that they do this intentionally. This will help US Citizens in general by reducing unemployment and at the same time grabbing Tax from us...

I feel contribution campaign for a specific initiative will have a better result than a general contribution.
The home page should show all the initiatives that is being worked on. Who is leading the effort and then people can contribute for those efforts. This way everyone will have a say in what they feel is more important by contributing more to that effort.
The reason i feel this is because currently the only way i can understand the progress about any initiative is by constantly reading the forum. A lot of times people change topics and open several threads. I need to keep pace with the posts. I spend several hours a day to keep up. I may not be able to do this forever.
Legal employement based immigration has various aspects.Initiative are vast ranging from F1 visas to Advance Parole. If we break the contribution by initiatives, people can visit those areas so they can contribute their time and money more effectively.
Just my 2 cents.

Try your best to find a job. The market is picking up. At least try to join one of those desi companies even if they are offering a low salary. Just get past this time without making your situation a whole lot more complex.
Dont worry about lawyers, your ex employer revoking I140 - all that stuff doesn't matter now - just go find a job.
I am not sure if I should be happy or sad with this news. I was laidoff recently and had applied for I-485 on July 17,2007 i.e. current processing date for TSC. Also with this bulletin I will be current (EB2 2006). I have not found a new job yet and my company has told me that they will be revoking my I-140 after 30 days. My company lawyers are not advising me much citing conflict of interest.
What options do I have? Will sending a new G-28 form at this time raise any issues that I do not have job with original employer as my PD is current and it is quite possible that my case maybe adjudicated. In the meantime if I do not sent new G-28 form I am not sure how much my company attorney will co-operate
