who will take care of the elderly parents in India? Since you're US citizen, u can apply GC for ur parents also. It's tough to leave ur old parents in India and just worry about a good lifestyle for the brother. None of my business but just a thought.

I am on my 7th year of H-1B (not stamped) and H-1B is due to expire in 2011. I am with the same employer since beginning of H-1B. My AOS is pending and have received AP and EAD.
I am planning to visit Canada next month and want to enter USA with the help of AP. My question is Can I continue my salary using H-1B with the same employer? I read somewhere that I can use my H-1B for salary processing in such circumstances provided I am working for same employer.

Got H1B this year via consultant,valid from Oct 1st to 2010. Applied for AOS(dervative) and got EAD, AP and I-485 receipt notice by Oct end. So I think my status is AOS now.
I haven't been put on project yet.
Planning to travel next month using AP.
On return I plan to find another job using EAD.
I wanted to know if and how using AP to re-enter effects H1B status.
Also will this "bench" period effect GC processing in anyway?

S-9, the amnesty bill introduced by Senator Scary Reid in January has no text and no calendar. Apparently Obama wants to choose his fights and knows that a bad bill, like S-9 will sink his popularity and the chances of getting what he feels is more significant legislation passed (Health Care). I heard now they are issuing passports in less than a week.
If he has a GC he can still visit on his old country passport without any issues.

one does not have to advertise for H1, might be they are advertisement is for filing your Labor application for GC.

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.

My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.

My I-140 & I-485 were filed concurrently in July and I have received the receipt notices last week. I have been told by my manager that I have been considered for a promotion. The job title changes from Sr.Database Administrator to Sr.Database Administrator,Staff. The new job after promotion will have additional/new responsibilities like leading/mentoring the team members in addition to the current job responsibilities. I have the following questions:
(1) Is there any risk to GC processing if the job title changes ?
(2) Is there anything that needs to be done/filed with USCIS to reflect the job title change ?
