    I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.

    Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
    (2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
    (3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?

    I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

    I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.

    Normally How long it take to get EAD from Texas Service center. ??

    Any idea. ??

    Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.

    They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

    Q6: What happens if an application is filed at the wrong Service Center?

    A6. Forms I-485 should be filed at either the Texas or Nebraska Service Centers. However, through August 17, 2007 only, employment-based adjustment applications filed at the California and Vermont Service Centers will not be rejected and will be relocated to the appropriate Service Center. Filing at the wrong location could result in processing delays.

    Hi,

    My brother is coming to USA on L1 visa.
    His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.

    Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?

    Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document


    I am currently on H1 but planning to go on H4 due to current economic scenario.
    I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
    I have my salary slips and my husband has also maintained his status throughout.
    Has anyone heard any horror stories about H4 stamping cases getting denied.

    What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

    Hi Gurus,

    If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
    My questions:
    1. Can I take Infopass appointment anywhere else which is not my local office?
    2. Can I apply a new 131 application at TSC as my 485 is there now?

    Someone pls advise.

    Congrats to IV core team on pulling something very improbable; filing I-485 till Aug 17th honoring the July visa bulletin.

    Any idea what are the options for Employment-based CP? I already applied for CP and am waiting for Packet 3. Packet 3 itself takes 6-8 weeks for processing. I tried to find info when visa number is alloted when u choose CP for greencard. I am getting conflicting information.

    Can I file I-485; can I switch to 485 from CP. How long does the switch take. Thanks for ur inputs.

    I work for a big company. Each time when I move to a new project, my company ask me to file an LCA and H-1B amendment for new project location. It takes several month to get approval until then you have wait and face all travel restrictions.
    I know that several smaller companies don�t file such amendments

    Does anyone who why do we have to file such amendment?
    What happens if we don�t file this?

I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent.     As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    The Administrative Appeals Office (AAO) Processing Times were released on November 4, 2009 with processing dates as of November 1, 2009

    If you filed an appeal, please review the links below to determine the applicable processing time associated with your particular case.

    The current processing time for an I-129 H-1B Appeal is 13 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 27 months. Most other cases are within USCIS's processing time goal of 6 months or less.
