As of May 29, 2009, approximately 45,800 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.

yes. it can be done inside USA by filing I-539.
The school must first issue I-20. Then, you can file I-539 with the INS by attaching the I-20.
INS will approve it and return you I-20 along with a new I-94.

Hi,
I have already filed my I-485 in Aug 2007. My employer is moving to a new office space in the same city. It is almost 2 miles from where I'm working now. Do I need to notify USCIS of this change? If so, how would I do it? Could anyone please suggest.

A RFE is not related to the type of processing (regular / PP) but depends on how well the petition was prepared.

Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

If you are a US citizen, apply for his green card by contacting some good immigration attorney. I hope some attorney in this website answers the question.
