I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.
My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.
Our L1 & L2 are valid until Aug 2011.
I don't have H4 yet.
What are the various options available for me to work?
1. Can I use my EAD to work which is valid until aug 2011?
2. Can I apply for H1B for me? If yes when I can start working with my H1B.
3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?

I had breakfast today with a few advocates and an Obama Administration official who noted that the immigration summit will now be held on June 25th. Encouraging. I also learned that the current expectation is that the immigration reform bill will likely start in the Senate and that Senator Reid is hoping for reform legislation to be considered in the fall.

Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

Switched jobs in April 07. My attorney tells me that my Labor can be filed only in mid July at the earliest.
1. How long does it take for Labor to be approved? I am guessing end of September is when retrogression will kick in. Do I have enough time for that?
2. How long does it take to get the documents ready for to file I-140 and I-485 (counting eggs before it's hatched)? If I have Birth and Marriage certificates ready, is there anything else that I should watch out for?
BTW, don't think I am trying to take a short cut to independence. I did my time in backlog for 3 years, got fed up and quit.

1) I am in USA on H1B.
2) I have accepted an offer to join companyA in January '07. They have filed for the H1B transfer a few days back. And I have resigned from my current employer.
3) Now another companyB has agreed to acquire companyA, and they will close the deal in December '06. CompanyB will be issuing revised offer letters to new hires like myself soon.
So even when my H1B has been filed by CompanyA, it will cease to exist on my joining date (January '07).
My question is how is the H1B handled in such a case ?
Can an amendment be sent to the original application saying its for CompanyB, and not CompanyA. Or does CompanyB have to apply for a fresh H1B ?
General qn : When can I change the employer -- when the H1 papers reach INS or when the lawyers get the receipt notice from INS ?
They are setting up conference calls with the lawyers soon; I was wondering if I could get some inputs from the experts on the forum as well.

I was working with company A and got approved I140(1 year back) after that I moved to company B using approved I140 and got 3 yrs H1B extension.After that during July,07 period I requested company A to apply EAD and i485(Company A mentioned as future employment).Now I am still with company B.
But now Company A asking me to come back.Since I have everything approved (i140) except i485(pending) do I need to go back to company A?
If I do not go to company A,can he cancel approved I140 ?
Need help/suggestion .

As we know, from January 1 2010, all the prevailing wage (PW) determinations have to be sent to DOL. My PW was submitted on March 1 2010 and I still have not got the determination. Can someone tell, how long is it taking on an average?

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien or not; and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.
I appreciate your response.
