Obviously, the prospects for major immigration reform legislation are being dealt a blow this evening. But it looks like the lord of the anti-immigrants - Tom Tancredo - is going down to defeat in the Colorado governor's race. Marco Rubio seemed to push an Arizona-like law for Florida in the election campaign, but his speech this evening was all about the immigrant dream. My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

I am on H1 and working at client place, my parents visited few months back. Some of my friends(who are at client place) in-laws/parents also visited. As long as you produce documents specified, there wont be any prblm with visitor visa.

Right now I am on my 5th year of H1B with company A. If I file for labor with Company B and got approved in a year with out holding a H1 in Company B . can i get 7th year h1 extension with company B as they already have my labor approved? any inputs will be a great help. thanks in advance.

Senate leadership is considering taking up the E-Verify reauthorization bill today before members depart for summer recess, so Senators are negotiating with Menendez in order to reach an accommodation.

Wilmer Rivera Melendez, 61, pretended to be a lawyer and offered to help more than a dozen undocumented Guyanese immigrants in Brooklyn to get green cards, has been indicted in an immigration fraud scheme in which he is accused of offering to marry two illegal Guyanese immigrants in Brooklyn to help them gain legal status. Robert M. Morgenthau, the Manhattan district attorney, also added that this man was earlier convicted of bigamy in Georgia six years ago.
Mr. Morgenthau claimed himself having 20 year of experience as a lawyer, filed documents with immigration authorities for �withholding of removal� that would have allowed immigrants to remain in the country and obtain green cards, which is actually does not allow one to obtain a green card. Instead, Mr. Melendez�s actions led federal immigration officials to begin deportation proceedings against the 14 Guyanese immigrants. The law provides for illegal immigrants who are victims of violent crime to receive temporary visas, but not victims of fraud.

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

Hi all,
I'm on my 5th year of H-1b visa. I had my I-797 approved until 10/30/12. My old passport was due to expire on 2/25/11 so during my recent trip my I-94 was given until 2/25/11, even though my visa is until 10/30/2012. So my lawyer filed I-539 to get a new I-94 on 2/20/11. I still didn't get my case number yet. Now I have another Job offer and the new company's lawyer says that i cannot take another job until this case is complete. I'm totally confused and not sure what to do. Please help. your help is very much appreciated.

do you get a FP notice only if you file AP and EAD along with your 485 ?

Hi All,
I just called USCIS using the POJ method to check on my I485 status which is current for June (EB2 India PD is 3/20/04).
IO said a visa needs to be ordered for the file and it will be done in the next quarter i.e, July 08.She also said the file will not be assigned to the IO unless the visa is ordered??
Does this mean that all the visas for EB2 have been used for this quarter? Also, not sure why the file wont be worked on until the visa is ordered...which contradicts the pre-adjudication theory.
