one of my friend worked here on L1 for couple of years for employer A.
then he got a H1 approved effective from Oct'07, with employer B.
but, he did not actually start working under employer B on H1 (payroll) until Mar'08.
he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.
now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.
question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?
appreciate any advice

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?
Or do I need to apply for I-485 freshly with I-140 from B?

I guess that is also H1B as H1B for non-profit organizations does not fall under yearly quota .they can get H1B anytime , so no need to wait til Oct.

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. I have two Approved I-140s (both filed by same company).
� Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
� Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.
I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?
Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?
I will appreciate your help.

Hi, I am a U.S. Citizen, and my husband is not. I would like to apply for unemployment benefits, but I am worried that it may affect his immigration process. We will soon apply for his green card with the help of a cosponsor. I wanted to make sure that he would not be affected at all by me claiming unemployment benefits. I figure that it wouldn't affect him because of the fact that we will be using a cosponsor, but I didn't want to risk it.
