This just dawned on me. They are supposed to following the current law of per country limit first before distributing it. But how come all the EB3 countries are not available while they are distributing "extra" visas to overscribed countries? Countries like Iceland should always be current as they do not have a lot of EB immigrants. So you would excpect that at least some countries still have EB3 visas. However, it is not the case.
The purpose is to demonstrate that they do not have a process to follow the law. They screwed up before and they are screwing up again now. There have been other facts about their mismanagement that can be used to make the case. Therefore, they should compensate people who have been here patiently waiting with good faith... one way is to speed up processing cases pending for more than 5 years.

I agree with the above posts, they are stealing money by having stupid charges. Why do you need to charge a customer Rs.400 for changing his account password. It is absolutely ridiculous! Compare that to a bank in US, you just go online and change the password. Also, they have 2 passwords one called Account password to login to the account and another called Transaction password for making any transactions. So the more number of passwords you have the more you tend to forget either of them and they can charge you Rs.400 for each password reset!:mad:

First of all congratulations to ind_game.
Today I received NOID for not submitting AC21. My I-140 is not revoked. I received an RFE last month for birth certificate & updated g-325a form. In the g-325a form I mentioned my current employer which would have triggered NOID for AC21.
I left the GC sponsored employer after 9 years on May 2008 well after 180 days and joined an insurance company. The company got hammered by financial crises. So I left that company and joined other stable company on Dec 2009 as a full time employee.
My current job description is similar to the one mentioned on ETA but not same. I am not sure if changing 2 jobs will be a problem.
If anyone had submitted any documents for AC21 please share. I will really appreciate it.

If I may suggest it may help our funding drive if we allow smaller contributions. (20$ or 10$) both recurring and one time.
I know at least a couple of people who would do a 20$ 2-3 times a year but won't do a $50. Anecdotal but may hold true for a lot more people.

Within a week of receiving the RFE, USCIS approved my EB3 I-140. It was going beyond limit - 20 months for a process which typically takes 6-8 months !! The last 8 months was most painful - I was been played like a Ping pong ball between NSC,Ombudsman,Congressman Ed Markey's office,My lawyer, My employer and Senator John Kerry's office.
But the at the end of it i would say - Senator John kerry's office really helped. Nebraska touched my case after receiving letter from them only. Congressman Ed Markey's office tried to help and said positive things but probably they don't have that much influence to shake the "laziest of the lazy" USCIS staffs.
My company sent the RFE (dated 12/9/08) reply yesterday 1/7/09 and today they received the package. Within 2 hrs my case status changed to "RFE response received and case resumed"
Lets see how fast USCIS adjudicates now. Just thought of sharing this milestone of my 20 month old I-140 Journey.

Rather I would like to add more items to what u have listed-
1. Its wrong for EB2 filers to find/marry a us citizen. That will be unethical of them to do as they will be jumping lines. Because u would be unable to do if u would have married non-citizen..so based on GCTest's logic please dont marry us citizen or if u have marriued continue to only use you EB2 application for processing :-)
2. Also people who are now planning of using EB5 (assuming u have now saved/gather enough money). So EB2, EB3 or other people u have been saving money and are now thinking of risking ur money/career/life on EB5 filing..please dont do that...because that will be unethical.....u r doing it bcos u now have money. Per GCTest's logic u did not having money u filed ur EB2 or EB3 application so if u have money now...dont try to use it.
GCTest...can u think of other conditions ...do post them.
Oh yes corollary to #1. Also bachelors in EB2/EB3 category make sure u dont fall inlove and plan to marry any girl/boy from the countries which are current. Help GCTest's cause.

Dear IV,
Its not about me. I am planning to do a flower or some campaign that all will agree upon in less than a week. We must do before the next bulletin comes out.
Is it possible for IV to send a very good number of flowers to the departments.
The basis for this is that some of the people here probably may not be comfortable to send to all the members due to whatever restrictions they may have(ideally they must be able to do themselves). If so, we can start a new campaign and make some fund and once again shoot that may flowers to make some difference. IV can go to a big place and place a huge order. Just my 2c.

I agree as well as disagree with Chandu.
India is where it is and US is where it is. Don't say you don't want to go because India is like this or want to get GC because US is like this. It's more like what you like or dislike (from India or US); hence you want to stay or go back. People prefer to stay place A as they cannot accommodate in place B and not because country cannot accommodate to what they like. I think that's more of a matter of personal choice.
Having said this, I agree to the fact that India has best things to offer "if once can afford" and "change should come to grassroots".
Moving back to the original question - do I feel like giving up? Yes, I do but I give up that feeling of giving up when I occasionally read what guild, plumberusa cartoons blabber and how much they hate us :)

I have reiterated this again and again. There is no way USCIS was going to accommodate all of us as per the original VB. We will form the biggest hump on the back of USCIS and it will probably 20 yrs for every one to come out of the system. Remember, how much math we did on how many years EB2 India /Eb3 india/china will take? Thats what they see as well. Why would they want so many applications backlogged. The only way they can disallow filings is by saying that there are no visa numbers available on day one. You have to have a visa number available at the time of 485 filing. They cleared out all the old PD's. Believe me, If the original bulletin was not current, they would have done the same in 90 days with some numbers gone waste. It was a bad situation for both agencies. I am not saying that they have not goofed up. they goofed up big time and I can clearly see the lack of communication on issue like this which effects so many people. We can use this as an opportunity to show case our root cause or we can use this in a detrimental way that will screw our nuts and bolts for 10 more years.

After reading ind_game last quote "God save AC21.....". I have following questions:
1. Do you know any one (your friend, client) used AC21 and faced same problem? Es
2. Is it true that AC-21 info don't get updated in the USCIS records?
3. If yes (2 question), then x-employer I-140 revocation will ALWAYS result in THIS kind of problems (as ind-game is facing)?
4. To attorneys only: Is AC-21 really helpful or misleading? Asking because if it don't update in USCIS records.

I have found some case studies and I am still in touch with them...........but everybody got thru this with a good ending........I have a series of case studies in another website's forum who have faced similar issue (of course, not 2 MTRs but just 1 MTR)...........I do not think it would be wise to post them here.........

One of my other friend did not submit any AC 21 and he got laid off from the changed company and he did not get any notification from USCIS. He is just moving ahead without filing any AC21.
One of my other friend changed jobs twice using AC 21 and he got NOIDs both times. NOID is common and according to the guidance in the memo (Yates memo). Trust me, I have contacted so many people in the past three months, I have enough case studies in my laptop now.

I found one very detailed thread on Ron Gotcher's website. He mentioned that cancellation or revocation of I-140 doesn't automatically revokes EAD.

Please don't think as if the IV guys walk in and talk and there you go.... the change is in effect.
It takes a lot to get the fixes like these.
Moreover , do not donate with the "IF" condition. Just donate and trust IV , everyone is working as hard ,to get the relief in any way possible for the guys in the line.
SO JUST DON'T WAIT AND START DONATING.
